3. ELIGIBILITY

  • the business operates lawfully within South Africa;
  • they will not use Contractor Hub for unlawful or fraudulent purposes.

5. FUNDING FACILITATION DISCLAIMER

Contractor Hub may facilitate introductions between contractors and independent funding partners.

Users acknowledge and agree that:

  • Contractor Hub does not provide loans;
  • Contractor Hub does not approve funding;
  • Contractor Hub does not guarantee funding outcomes;
  • all funding decisions remain solely with independent funding partners;
  • funding assessments are conducted independently by funding partners;
  • Contractor Hub does not influence underwriting decisions;
  • Contractor Hub does not provide financial advice.

Funding approvals remain subject to:

  • risk assessments;
  • compliance reviews;
  • funding partner criteria;
  • document verification;
  • independent underwriting processes.

Users acknowledge that all funding engagements remain solely between the contractor and the relevant funding partner.

6. COMMISSION DISCLOSURE

Users expressly acknowledge and agree that Contractor Hub may receive:

  • commissions;
  • referral fees;
  • facilitation fees;
  • origination fees;
  • commercial compensation;
  • performance-based remuneration,

from independent funding partners where funding transactions or related commercial transactions are successfully concluded.

Users acknowledge that:

  • such compensation forms part of Contractor Hub’s commercial business model;
  • Contractor Hub is entitled to commercial compensation for contractor origination and facilitation services;
  • such compensation arrangements do not constitute financial advice or lending services.

7. CONTRACTOR SUBMISSIONS

Users submitting information to Contractor Hub agree that:

  • all submitted information is true, accurate, and complete;
  • all documents submitted are authentic and lawful;
  • submitted information does not infringe the rights of third parties;
  • no misleading or fraudulent information will be submitted.

Users remain solely responsible for:

  • submitted information;
  • project information;
  • financial documentation;
  • contractor compliance;
  • funding application accuracy;
  • supporting documentation.

Contractor Hub reserves the right to:

  • reject submissions;
  • request additional documentation;
  • suspend applications;
  • remove inaccurate or misleading submissions;
  • terminate participation where fraud or misrepresentation is suspected.

8. CONTRACTOR NETWORK PARTICIPATION

By submitting information through Contractor Hub, users acknowledge and agree that:

  • their business may become part of the Contractor Hub contractor network;
  • Contractor Hub may process contractor-related information;
  • Contractor Hub may use contractor information for contractor participation and operational purposes;
  • Contractor Hub may utilise contractor information for contractor matching, analytics, visibility, and operational development purposes.

9. POPIA CONSENT

By using Contractor Hub or submitting information through the platform, users expressly consent to Contractor Hub:

  • collecting information;
  • storing information;
  • processing information;
  • profiling contractor information;
  • verifying information;
  • sharing information with funding partners and service providers;
  • communicating with users regarding contractor participation and funding-related matters.

17. INDEMNITY

  • penalties;
  • costs;

  • funding disputes;
  • project disputes;
  • unlawful conduct;
  • misuse of Contractor Hub;
  • reliance on information published through Contractor Hub;
  • third-party claims;
  • regulatory breaches;
  • non-compliance with applicable laws;
  • intellectual property infringements;
  • contractor or funding-related losses.

This indemnity survives termination of platform use.

18. NON-CIRCUMVENTION

Users acknowledge that Contractor Hub operates as a contractor origination and funding facilitation platform.

Users may not intentionally circumvent Contractor Hub in relation to funding opportunities, funding introductions, or commercial relationships introduced through Contractor Hub where such circumvention unfairly prejudices Contractor Hub’s commercial interests.

Contractor Hub reserves the right to pursue legal remedies relating to unlawful circumvention or interference with Contractor Hub commercial relationships.

19. DATA SECURITY
